Foto: Carol M. Highsmith, Public Domain Die Fotografin Carol M. Highsmith bekommt von Getty eine Abmahnung, weil sie Bilder aus dem Getty-Sortiment auf ihrer Webseite hatte, ohne dafür gezahlt zu haben. Soweit, so normal.
Nun war es so, dass eben jene Bilder von der eigentlichen Fotografin an den Library of Congress verschenkt worden sind – und somit für jedermann unter Public Domain ohne weiteren ©-Bullshit nutzbar sein sollten.
Dann aber stellt sich raus, dass diese Bilder von Highsmith selber stammen. Sie also Urheberin dieser Bilder ist, die Getty dann, ohne sie zu fragen in den Lizenz-Katalog übernommen und sie nun für die Verwendung ihrer eigenen Bilder abgemahnt hat. Noch mehr ©-Bullshit-Meta-Irrsinn geht ja kaum noch.
Jetzt klagt sie gegen Getty. Sie ist scheinbar nicht die einzige, der das so mit Getty Images widerfahren ist. Ihre Forderung: 1 Milliarde Dollar.

In addition to accusing Highsmith of copyright infringement involving her own photo, Getty reportedly also sent similar demand letters to other people using Highsmith’s public domain photos.
“The defendants [Getty Images] have apparently misappropriated Ms. Highsmith’s generous gift to the American people,” the lawsuit reads. “[They] are not only unlawfully charging licensing fees…but are falsely and fraudulently holding themselves out as the exclusive copyright owner.”
